Hizmetler Shopify tarafından barındırıldığından, Shopify, Hizmetleri sizin için sağlamak ve iyileştirmek amacıyla Hizmetlere erişiminiz ve kullanımınızla ilgili kişisel bilgileri toplar ve işler. Hizmetlere gönderdiğiniz bilgiler, size hizmet sağlamak amacıyla, Shopify'ın yanı sıra ikamet ettiğiniz ülkeden başka ülkelerde bulunabilecek üçüncü taraflara iletilecek ve paylaşılacaktır. Bizim, Shopify'ın ve ortaklarımızın kişisel bilgilerinizi nasıl kullandığı hakkında daha fazla bilgi için gizlilik politikamızı [LİNK] inceleyin. BÖLÜM 11 - GERİ BİLDİRİM Herhangi bir fikir, öneri, geri bildirim, inceleme, teklif, plan veya başka bir içerik (toplu olarak "Geri Bildirim") gönderir, yükler, yayınlar, e-posta ile gönderir veya başka bir şekilde iletirseniz, bize bu Geri Bildirim'i ticari kullanım da dahil olmak üzere herhangi bir amaçla herhangi bir ortamda kullanma, çoğaltma, değiştirme, yayınlama, dağıtma ve görüntüleme konusunda sürekli, dünya çapında, alt lisanslanabilir ve telifsiz bir lisans vermiş olursunuz. Örneğin, bu lisans kapsamındaki haklarımızı Hizmetleri işletmek, sağlamak, değerlendirmek, geliştirmek, iyileştirmek ve tanıtmak ve Hizmet Şartları kapsamındaki yükümlülüklerimizi yerine getirmek ve haklarımızı kullanmak için kullanabiliriz.




Ayrıca şunları beyan ve garanti edersiniz: (i) tüm Geri Bildirimlerin sahibisiniz veya tüm gerekli haklara sahipsiniz; (ii) Geri Bildirim gönderiminizle bağlantılı olarak aldığınız herhangi bir tazminat veya teşviki açıkladınız; ve (iii) Geri Bildiriminiz bu Şartlara uygun olacaktır. (1) Geri Bildiriminizi gizli tutmak; (2) Geri Bildiriminiz için tazminat ödemek; veya (3) Geri Bildiriminize yanıt vermek gibi hiçbir yükümlülüğümüz yoktur ve olmayacaktır.
Kendi takdirimize bağlı olarak yasa dışı, saldırgan, tehdit edici, iftira niteliğinde, onur kırıcı, pornografik, müstehcen veya başka bir şekilde sakıncalı olduğunu veya herhangi bir tarafın fikri mülkiyetini veya bu Hizmet Şartlarını ihlal ettiğini belirlediğimiz Geri Bildirimleri izleyip düzenleyebilir veya kaldırabiliriz, ancak bu yönde bir yükümlülüğümüz yoktur.
Geri Bildiriminizin telif hakkı, ticari marka, gizlilik, kişilik veya diğer kişisel veya mülkiyet hakkı dahil olmak üzere herhangi bir üçüncü tarafın hiçbir hakkını ihlal etmeyeceğini kabul edersiniz. Ayrıca, Geri Bildiriminizin iftira niteliğinde veya başka bir şekilde yasa dışı, taciz edici veya müstehcen Geri Bildirim içermeyeceğini veya Hizmetlerin veya ilgili herhangi bir web sitesinin çalışmasını herhangi bir şekilde etkileyebilecek herhangi bir bilgisayar virüsü veya başka bir kötü amaçlı yazılım içermeyeceğini kabul edersiniz. Sahte bir e-posta adresi kullanamaz, kendinizden başka biri gibi davranamaz veya herhangi bir Geri Bildirimin kaynağı konusunda bizi veya üçüncü tarafları yanıltamazsınız. Yaptığınız herhangi bir Geri Bildirimden ve doğruluğundan yalnızca siz sorumlusunuz. Siz veya herhangi bir üçüncü tarafça gönderilen herhangi bir Geri Bildirim için hiçbir sorumluluk kabul etmiyoruz ve hiçbir yükümlülük üstlenmiyoruz.

BÖLÜM 12 - HATALAR, YANLIŞLIKLAR VE EKSİKLİKLER
Bazen Hizmetlerde veya Hizmetler üzerinde ürün açıklamaları, fiyatlandırma, promosyonlar, teklifler, ürün nakliye ücretleri, transit süreleri ve bulunabilirlikle ilgili olabilecek tipografik hatalar, yanlışlıklar veya eksiklikler içeren bilgiler olabilir. Herhangi bir hata, yanlışlık veya eksikliği düzeltme, herhangi bir bilginin yanlış olması durumunda herhangi bir zamanda önceden haber vermeksizin (siparişinizi verdikten sonra da dahil olmak üzere) bilgileri değiştirme veya güncelleme ya da siparişleri iptal etme hakkını saklı tutarız.

BÖLÜM 13 - YASAK KULLANIMLAR
Hizmetlere yalnızca yasal amaçlarla erişebilir ve bunları kullanabilirsiniz. Hizmetlere doğrudan veya dolaylı olarak erişemez veya bunları kullanamazsınız: (a) herhangi bir yasa dışı veya kötü niyetli amaç için; (b) herhangi bir uluslararası, federal, eyalet veya eyalet düzenlemesini, kuralını, yasasını veya yerel yönetmeliğini ihlal etmek için; (c) fikri mülkiyet haklarımızı veya başkalarının fikri mülkiyet haklarını ihlal etmek veya çiğnemek için; (d) çalışanlarımızdan herhangi birini veya herhangi bir başka kişiyi taciz etmek, kötüye kullanmak, hakaret etmek, zarar vermek, iftira atmak, karalamak, küçük düşürmek, sindirmek veya zarar vermek için; (e) yanlış veya yanıltıcı bilgi iletmek için; (f) bu Şartlara uymayan herhangi bir materyali göndermek, bilerek almak, yüklemek, indirmek, kullanmak veya yeniden kullanmak için; (g) herhangi bir "istenmeyen posta", "zincir mektup", "spam" veya benzeri herhangi bir talep dahil olmak üzere herhangi bir reklam veya tanıtım materyalini iletmek veya gönderilmesini sağlamak için; (h) başka bir kişiyi veya kuruluşu taklit etmek veya taklit etmeye çalışmak için; veya (i) herhangi birinin Hizmetleri kullanmasını veya keyfini çıkarmasını kısıtlayan veya engelleyen veya tarafımızca belirlendiği üzere MyCixx, Shopify veya Hizmet kullanıcılarına zarar verebilecek veya onları sorumluluğa maruz bırakabilecek herhangi bir başka davranışta bulunmak.
Ayrıca, şunları yapmamayı kabul edersiniz: (a) Hizmetlerin işlevselliğini veya işleyişini herhangi bir şekilde etkileyecek veya etkileyebilecek virüsleri veya başka herhangi bir kötü amaçlı kodu yüklemek veya iletmek; (b) Hizmetlerin herhangi bir bölümünü çoğaltmak, kopyalamak, satmak, yeniden satmak veya istismar etmek; (c) başkalarının kişisel bilgilerini toplamak veya izlemek; (d) spam yapmak, kimlik avı yapmak, pharm yapmak, bahane bulmak, örümcek ağı kullanmak, taramak veya kazımak; veya (e) Hizmetlerin veya ilgili herhangi bir web sitesinin, diğer web sitelerinin veya İnternet'in güvenlik özelliklerine müdahale etmek veya bunları aşmak. Bu Şartlar'ın herhangi bir bölümünü ihlal ettiğinizi tespit edersek, hesabınızı herhangi bir zamanda ve bildirimde bulunmaksızın askıya alma, devre dışı bırakma veya sonlandırma hakkımızı saklı tutarız.

BÖLÜM 14 - FESİH
Bu sözleşmeyi veya Hizmetlere (veya herhangi bir kısmına) erişiminizi, tamamen kendi takdirimize bağlı olarak, herhangi bir zamanda ve önceden bildirimde bulunmaksızın feshedebiliriz ve fesih tarihine kadar ve bu tarih de dahil olmak üzere tüm tutarlardan sorumlu olmaya devam edersiniz.
Herhangi bir fesih sonrasında aşağıdaki bölümler geçerli olmaya devam edecektir: Fikri Mülkiyet, Geri Bildirim, Fesih, Garanti Reddi, Sorumluluğun Sınırlandırılması, Tazminat, Bölünebilirlik, Feragat; Sözleşmenin Tamamı, Devir, Geçerli Hukuk, Gizlilik Politikası ve doğası gereği fesih sonrasında da geçerliliğini koruması gereken diğer hükümler.

BÖLÜM 15 - GARANTİ REDDİ
Hizmetler aracılığıyla sunulan bilgiler yalnızca genel bilgilendirme amacıyla sunulmaktadır. Bu bilgilerin doğruluğunu, eksiksizliğini veya yararlılığını garanti etmiyoruz. Bu bilgilere güvenmeniz tamamen kendi sorumluluğunuzdadır. Sizin veya Hizmetleri ziyaret eden herhangi bir kişinin ya da içeriğinden haberdar olabilecek herhangi bir kişinin bu materyallere güvenmesi nedeniyle doğabilecek her türlü sorumluluk ve yükümlülüğü reddediyoruz.
MyCixx tarafından açıkça belirtilmediği sürece, HİZMETLER VE HİZMETLER ARACILIĞIYLA SUNULAN TÜM ÜRÜNLER, SATILABİLİRLİK, SATILABİLİR KALİTE, BELİRLİ BİR AMACA UYGUNLUK, DAYANIKLILIK, MÜLKİYET VE İHLAL ETMEME GARANTİLERİ VE KOŞULLARI DAHİL OLMAK ÜZERE, HERHANGİ BİR AÇIK VEYA ZIMNİ BEYAN, GARANTİ VEYA KOŞUL OLMADAN, KULLANIMINIZ İÇİN 'OLDUĞU GİBİ' VE 'MEVCUT OLDUĞU ŞEKİLDE' SAĞLANMAKTADIR. HİZMETLERİ KULLANIMINIZIN KESİNTİSİZ, ZAMANINDA, GÜVENLİ VEYA HATASIZ OLACAĞINI GARANTİ ETMİYOR, BEYAN ETMİYOR VEYA TEMİNAT VERMİYORUZ. BAZI YARGI BÖLGELERİ ZIMNİ VEYA DİĞER GARANTİLERİN REDDİNİ SINIRLAR VEYA İZİN VERMEZ, BU NEDENLE YUKARIDAKİ REDDİN SİZE UYGULANMAYABİLİR.

BÖLÜM 16 - SORUMLULUĞUN SINIRLANDIRILMASI
YASALARIN VERDİĞİ EN GENİŞ ÖLÇÜDE, HİÇBİR DURUMDA MyCixx, ORTAKLARIMIZ, YÖNETİCİLERİMİZ, MEMURLARIMIZ, ÇALIŞANLARIMIZ, BAĞLI KURULUŞLARIMIZ, ACENTELERİMİZ, YÜKLENİCİLERİMİZ, HİZMET SAĞLAYICILARIMIZ VEYA LİSANS VERENLERİMİZ VEYA SHOPIFY VE BAĞLI KURULUŞLARININ KİŞİLERİ, SÖZLEŞMEYE VEYA HAKSIZ FİİLE DAYALI OLSUN, KAYIP KAR, KAYIP GELİR, KAYIP TASARRUF, VERİ KAYBI, YEDEKLEME MALİYETLERİ VEYA BENZER ZARARLAR DAHİL ANCAK BUNLARLA SINIRLI OLMAMAK ÜZERE HERHANGİ BİR YARALANMA, KAYIP, TALEP VEYA HERHANGİ BİR DOĞRUDAN, DOLAYLI, ARIZİ, CEZAİ, ÖZEL VEYA SONUÇ OLARAK ORTAYA ÇIKAN ZARARLARDAN SORUMLU TUTULAMAZ. (İHMAL DAHİL), KUSURSUZ SORUMLULUK VEYA BAŞKA ŞEKİLDE, HİZMETLERDEN HERHANGİ BİRİNİ VEYA HİZMETLERİ KULLANARAK ELDE EDİLEN HERHANGİ BİR ÜRÜNÜ KULLANIMINIZDAN KAYNAKLANAN VEYA HİZMETLERİ VEYA HERHANGİ BİR ÜRÜNÜ KULLANIMINIZLA HERHANGİ BİR ŞEKİLDE İLGİLİ HERHANGİ BİR TALEPTEN, ANCAK BUNLARLA SINIRLI OLMAMAK ÜZERE, HERHANGİ BİR İÇERİKTEKİ HERHANGİ BİR HATA VEYA EKSİKLİK VEYA HİZMETLERİN KULLANIMI VEYA HİZMETLER ARACILIĞIYLA YAYINLANAN, İLETİLEN VEYA BAŞKA BİR ŞEKİLDE KULLANIMA SUNULAN HERHANGİ BİR İÇERİĞİN (VEYA ÜRÜNÜN) KULLANIMI SONUCU ORTAYA ÇIKAN HERHANGİ BİR TÜRDEKİ HERHANGİ BİR KAYIP VEYA HASAR DAHİL, OLASILIKLARI BİLDİRİLMİŞ OLSA BİLE.

BÖLÜM 17 - TAZMİNAT
MyCixx'i, Shopify'ı ve bağlı kuruluşlarımızı, ortaklarımızı, yöneticilerimizi, müdürlerimizi, çalışanlarımızı, temsilcilerimizi, yüklenicilerimizi, lisans verenlerimizi ve hizmet sağlayıcılarımızı, (1) bu Hizmet Şartları'nı veya bunların atıfta bulunduğu belgeleri ihlal etmenizden, (2) herhangi bir yasayı veya üçüncü bir tarafın haklarını ihlal etmenizden veya (3) Hizmetlere erişiminizden ve kullanımınızdan kaynaklanan veya bunlardan doğan her türlü kayıp, hasar, yükümlülük veya talepten (makul avukatlık ücretleri dahil) tazmin etmeyi, savunmayı ve zarar görmemelerini sağlamayı kabul edersiniz.
Tazmin edilebilir herhangi bir talep hakkında sizi bilgilendireceğiz; ancak derhal bildirimde bulunmamanız, maddi olarak zarara uğramadığınız sürece yükümlülüklerinizi ortadan kaldırmaz. Avukat seçimi de dahil olmak üzere, bu tür taleplerin savunmasını ve çözümünü masrafları size ait olmak üzere kontrol edebiliriz; ancak sizin izniniz olmadan (makul olmayan bir şekilde esirgenmemelidir) sizden parasal olmayan yükümlülükler gerektiren hiçbir talebi çözüme kavuşturmayacağız. Tazmin edilebilir taleplerin savunmasında, ilgili belgeleri sağlamak da dahil olmak üzere, iş birliği yapacaksınız.

BÖLÜM 18 - BÖLÜNEBİLİRLİK
Bu Hizmet Şartları'nın herhangi bir hükmünün hukuka aykırı, geçersiz veya uygulanamaz olduğu tespit edilirse, söz konusu hüküm yine de geçerli yasaların izin verdiği en geniş ölçüde uygulanabilir olacak ve uygulanamaz kısım bu Hizmet Şartları'ndan ayrılmış sayılacak; bu tespit, kalan diğer hükümlerin geçerliliğini ve uygulanabilirliğini etkilemeyecektir.

BÖLÜM 19 - FERAGAT; SÖZLEŞMENİN TAMAMI
Bu Hizmet Şartları'nın herhangi bir hakkını veya hükmünü kullanmamamız veya uygulamamamız, söz konusu haktan veya hükümden feragat ettiğimiz anlamına gelmeyecektir.
Bu Hizmet Şartları ve bu sitede veya Hizmet ile ilgili olarak tarafımızca yayınlanan tüm politikalar veya işletme kuralları, sizinle aramızdaki tüm sözleşme ve anlayışı oluşturur ve Hizmeti kullanımınızı düzenler, sizinle aramızdaki önceki veya eş zamanlı tüm sözleşmelerin, iletişimlerin ve tekliflerin (Hizmet Şartları'nın önceki sürümleri dahil ancak bunlarla sınırlı olmamak üzere) yerini alır.
Bu Hizmet Şartları'nın yorumlanmasındaki herhangi bir belirsizlik, taslağı hazırlayan tarafa karşı yorumlanmayacaktır.

BÖLÜM 20 - DEVİR
Bu Sözleşme'yi veya bu Şartlar kapsamındaki haklarınızı veya yükümlülüklerinizi önceden yazılı onayımız olmadan devredemez, transfer edemez veya temlik edemezsiniz ve bu tür herhangi bir girişim geçersiz ve hükümsüz olacaktır. Bu Şartları ve haklarımızı ve yükümlülüklerimizi sizin onayınız veya size bildirimde bulunmadan devredebilir, atayabilir veya temlik edebiliriz.

BÖLÜM 21 - GEÇERLİ KANUN
Bu Hizmet Şartları ve size Hizmetler sunduğumuz ayrı sözleşmeler, MyCixx'in merkezinin bulunduğu yargı bölgesindeki federal, eyalet veya bölge mahkemelerine tabi olacak ve bu mahkemelere göre yorumlanacaktır. Siz ve MyCixx, bu mahkemelerde yargı yetkisini ve kişisel yargı yetkisini kabul edersiniz.

BÖLÜM 22 - BAŞLIKLAR
Bu sözleşmede kullanılan başlıklar yalnızca kolaylık sağlamak amacıyla eklenmiştir ve bu Şartları sınırlamayacak veya başka şekilde etkilemeyecektir.

BÖLÜM 23 - HİZMET ŞARTLARINDAKİ DEĞİŞİKLİKLER
Hizmet Şartları'nın en güncel sürümünü istediğiniz zaman bu sayfadan inceleyebilirsiniz.
Bu Hizmet Şartları'nın herhangi bir bölümünü, kendi takdirimize bağlı olarak, web sitemizde güncellemeler ve değişiklikler yayınlayarak güncelleme, değiştirme veya değiştirme hakkını saklı tutarız. Değişiklikler için web sitemizi düzenli olarak kontrol etmek sizin sorumluluğunuzdadır. Bu Şartlar'da yapılacak önemli değişiklikler hakkında sizi yürürlükteki yasalara uygun olarak bilgilendireceğiz ve bu değişiklikler bildirimde belirtilen tarihte yürürlüğe girecektir. Bu Hizmet Şartları'nda herhangi bir değişikliğin yayınlanmasının ardından Hizmetleri kullanmaya veya Hizmetler'e erişmeye devam etmeniz, söz konusu değişiklikleri kabul ettiğiniz anlamına gelir.
